Background
The Programme for Government in 2012 included a commitment to “review the Mental Health Act 2001 in consultation with service users, carers and other stakeholders, informed by human rights standards” and a Steering Group was set up by the Minister of State at the Department of Health at that time Kathleen Lynch to begin the process which included receiving submissions from organisations, the general public, etc.
In June 2012, the Steering Group produced a report (see below) entitled ‘Interim Report of the Steering Group on the Review of the Mental Health Act 2001’. Minister Lynch then set up an Expert Group on which Dr Brendan Kelly was the College nominated consultant psychiatrist. Dr Pat Bracken was the second consultant psychiatrist member appointed by Minister Lynch.
The College held a members-only conference and workshop in October 2012 from which a proceedings of conference document and consultation document were developed (see below). These documents were sent to all members for comment and a private forum for members was set up to have a real time discussion and comment.
Recent Developments
The formation of the Expert Group along with the solicited submissions from 2012 formed the foundation of the Expert Group Review of the 2001 Act, published in March 2015. This was followed by a second public consultation which took place in March – April 2021, which yielded 100 responses, including from the College of Psychiatrists of Ireland. The Department of Health’s report on this consultation was published in October 2021.
